Terms and Conditions

1. Parties and Structure of Agreement
These Terms and Conditions (“Terms”) govern participation in journeys known as The Crow’s Flight and form a legally binding agreement only once a tour has been confirmed as proceeding and a booking has been accepted.
The parties to this agreement are:
- Eating History Pty Ltd (Australia), acting as tour designer, narrative curator, marketing entity, and booking administrator; and
- The Crow’s Flight Pty Ltd (Australia), acting solely as tour operator, responsible for on-the-ground delivery in Slovenia.
Each entity is responsible only for the functions expressly allocated to it under these Terms and does not assume responsibility for functions allocated to the other.
2. Expressions of Interest, Tour Formation, and Bookings
2.1 Expressions of Interest
Requests for information, registrations of interest, provisional participation discussions, or inclusion in pre-departure communications do not constitute a booking and do not create a contractual relationship.
2.2 Tour Confirmation
Tours operate under a producer model and proceed only if a viable group forms by a stated decision date.
A tour is considered confirmed only when participants are formally notified in writing that the tour will proceed.
2.3 Formation of a Booking
A legally binding booking exists only after:
- the tour has been confirmed as proceeding; and
- a participant has been invited to book and has made payment in accordance with Section 7.
Until these conditions are met, no booking, payment obligation, or cancellation right arises.
3. Allocation of Roles, Reliance, and Responsibility
3.1 Eating History Pty Ltd
Eating History Pty Ltd is responsible solely for:
- tour design and narrative framing;
- marketing and representations;
- administration of bookings and payments after tour confirmation;
- pre-departure information and documentation.
Eating History Pty Ltd does not exercise operational control once a tour has commenced.
3.2 The Crow’s Flight Pty Ltd
The Crow’s Flight Pty Ltd is responsible solely for:
- operational delivery of tours in Slovenia;
- on-the-ground logistics and group coordination;
- real-time safety and operational decisions during the tour.
The Crow’s Flight Pty Ltd does not exercise editorial, narrative, or representational authority.
3.3 Reliance Containment
Participants acknowledge and agree that:
- they do not rely on Eating History Pty Ltd for on-the-ground operational or safety decisions; and
- they do not rely on The Crow’s Flight Pty Ltd for narrative framing or pre-departure representations.
No reliance is created beyond the responsibilities expressly allocated.
3.4 No Partnership or Joint Venture
Nothing in these Terms creates a partnership, joint venture, or agency relationship beyond the functions expressly stated. References to “we”, “us”, or “our” are for convenience only.
4. Nature and Limits of the Tour Experience
Crow’s Flight journeys are guided cultural, historical, and experiential walking tours.
Tours may involve:
- sustained walking and moderate physical exertion;
- variable terrain, weather, and environmental conditions;
- engagement with historic sites, landscapes, and local narratives.
Narrative content provided during tours is:
- interpretive and contextual;
- offered for experiential and educational purposes;
- not presented as definitive or authoritative.
Participation does not confer ownership of stories, authority to represent cultural material, or rights to commercially exploit tour content.
5. Eligibility, Health, and Fitness
Participants are responsible for ensuring they are physically and medically fit to participate.
- Minimum age: 14 years
- Participants under 18 must be accompanied by a parent or legal guardian
- Relevant medical conditions must be disclosed prior to departure
Neither entity provides medical advice or medical services.
6. Passports, Visas, and Entry Requirements
Participants are solely responsible for meeting all passport, visa, and entry requirements.
Any information provided is general only and not a guarantee.
7. Prices, Payments, and Deposits
7.1 Pricing
All prices are quoted in euros (EUR) unless expressly stated otherwise in writing.
Prices relate to a confirmed tour only.
7.2 Payments
Payments are requested only after a tour has been confirmed as proceeding.
A deposit may be required to secure a confirmed booking. Final payment deadlines will be specified at the time of confirmation.
No payment obligation exists prior to tour confirmation.
7.3 Price Adjustments
Prices may change prior to full payment due to factors beyond reasonable control, including exchange movements, supplier cost changes, or regulatory requirements.
Once paid in full, prices will not increase except as permitted by applicable consumer law.
8. Non-Running Tours
If a tour does not proceed because a viable group does not form:
- no booking is created;
- no cancellation has occurred; and
- no payment obligation arises.
This outcome does not constitute a breach of contract by either party.
9. Cancellations and Changes by Participants (After Booking)
Once a booking has been confirmed:
- cancellations must be made in writing;
- cancellation fees reflect genuine, non-recoverable costs and are detailed in Essential Trip Information.
No refunds are available for:
- failure to join the tour;
- late arrival or early departure;
- unused services after tour commencement.
Participants are strongly advised to obtain cancellation insurance.
10. Changes or Cancellations by Us (After Confirmation)
After tour confirmation, a tour may be cancelled or materially altered due to events beyond reasonable control.
Where permitted by law, participants may choose to:
- transfer to an alternative departure (subject to availability), or
- receive a refund of amounts paid in euros (EUR), less demonstrable, non-recoverable costs.
11. Itinerary Adjustments
Reasonable itinerary adjustments may be required due to local conditions or safety considerations.
Minor changes do not constitute a breach of contract.
12. Conduct, Authority, and Procedural Fairness
Tour leaders appointed by The Crow’s Flight Pty Ltd hold operational authority during the tour.
Participants must follow lawful and reasonable instructions and behave in a manner that does not endanger others or disrupt the group.
Participants may be removed for serious misconduct or safety risks. No refund is payable in such cases, subject to applicable law.
13. Photography, Recording, and Image Use
Participants may take photographs or recordings for private, non-commercial use.
Use of participant images for promotional purposes requires voluntary, specific consent, which may be withdrawn for future use.
14. Cultural Respect and Ethical Boundaries
Participation does not grant permission to publish, commercialise, or claim authority over cultural or historical material encountered during the tour.
15. Privacy and Data Protection
Eating History Pty Ltd acts as primary data controller.
The Crow’s Flight Pty Ltd acts as data processor for operational delivery.
Data is handled in accordance with applicable data protection laws, including GDPR where relevant.
16. Liability
To the extent permitted by law, neither entity is liable for loss, injury, or delay arising from events beyond reasonable control or acts of third-party providers.
Mandatory consumer protections are not excluded.
17. Complaints and Resolution
Concerns should be raised promptly with the tour leader.
Unresolved complaints must be submitted in writing within 30 days of tour completion.
18. Governing Law
These Terms are governed by the laws of Australia.
Nothing limits mandatory consumer rights applicable in the participant’s country of residence.
19. Severability
If any provision is unenforceable, the remaining provisions continue in full force and effect.
